Curatore fallimentare:modifica dei requisiti per la nomina

La L. 132/2015 di conversione del D.L. 83/2015, all’art. 5 ha apportato modifiche all’art. 28 del regio decreto 267/1942. L’articolo del Decreto in questione ha previsto, con la soppressione delle parole “durante i due anni anteriori alla dichiarazione di fallim ento”, che non può essere nominato curatore il coniuge, i parenti e gli affini entro il quarto grado del fallito, i creditori di questo e chi ha concorso al dissesto dell'impresa nonché chiunque si trovi in conflitto di interessi con il fallimento.

La nuova versione dell’art. 28, della legge fallimentare, con riguardo ai fallimenti dichiarati dal 20/08/2015, è stato riscritta dalla legge di conversione del D.L. 83/2015 in quanto quest’ultimo prevedeva le seguenti condizioni per la nomina a curatore ovvero:

  • non bisognava avere rapporti di parentela, essere creditore o concorso al dissesto dell’impresa durante i 5 anni anteriori alla dichiarazione di fallimento;
  • non bisognava aver svolto la funzione di commissario giudiziale in relazione a procedura di concordato per il medesimo debitore, nonché chi sia unito in associazione professionale con chi abbia svolto tale funzione;
  • doveva essere in possesso di una struttura organizzativa e di risorse che appaiano adeguate al fine del rispetto dei tempi previsti dal programma di liquidazione di cui all’articolo 104‐ter.

E’ stato previsto inoltre, sempre con riguardo ai fallimenti dichiarati dal 20/08/2015 (data di entrata in vigore della L. 132/201

5), che il curatore è nominato tenuto conto delle risultanze dei rapporti riepilogativi di cui all'articolo 33, co. 5, legge fallimentare (oggetto di modifica dal D.L. 179/2012), che prevede che lo stesso, ogni sei mesi successivi alla presentazione della relazione al giudice delegato sulle cause e circostanze del fallimento, sulla diligenza spiegata dal fallito nell'esercizio dell'impresa, sulla responsabilità del fallito o di altri e su quanto può interessare anche ai fini delle indagini preliminari in sede penale, redige altresì un rapporto riepilogativo delle attività svolte insieme agli estratti conto dei depositi postali o bancari, di cui viene fornita una copia al comitato dei creditori, che può a tal fine formulare osservazioni, un’altra copia viene trasmessa per via telematica all'ufficio del registro delle imprese, nei 15 giorni successivi alla scadenza del termine per il deposito delle osservazioni nella cancelleria del tribunale e altra copia è  trasmessa a mezzo PEC, sempre entro 15 giorni, ai creditori e ai titolari di diritti sui beni.

Ai fini del controllo, è istituito presso il Ministero della giustizia un registro nazionale nel quale confluiscono i provvedimenti di nomina dei curatori, dei commissari giudiziali e dei liquidatori giudiziali. Il registro in esame, tenuto con modalità informatiche e accessibile al pubblico, riporta anche i provvedimenti di chiusura del fallimento e di omologazione del concordato, nonché l'ammontare dell'attivo e del passivo delle procedure chiuse. Le disposizioni relative al registro nazionale acquistano efficacia decorsi 60 giorni dalla pubblicazione sul sito internet del Ministero della giustizia delle specifiche tecniche previste dall'articolo 16‐bis, comma 9‐septies, del D.L. 179/2012 (L. 221/2012), da adottarsi entro sei mesi dalla data di entrata in vigore del presente decreto.
